Alabama rules that affect sellers

Transfer tax

Alabama charges a deed recordation tax of $0.50 per $500 of value or fraction thereof (Code of Alabama sections 40-22-1 through 40-22-12), about 0.1% of the sale price. State law does not assign the tax to either party, so who pays is set by the purchase contract. The state keeps two-thirds and the county receives one-third.

Local add-ons: No separate county or city transfer tax is listed by the Department of Revenue; one-third of the state tax goes to the county. Recording fees are set by the county probate office.

Seller disclosure

Alabama has no statutory seller disclosure form and follows caveat emptor (buyer beware) for used homes. Courts recognize exceptions: a seller must disclose known material defects that affect health or safety and are not readily observable, must answer a buyer's direct questions truthfully, and has a duty to disclose where a fiduciary relationship exists.

Who handles the closing

Title companies and other nonlawyers may conduct the closing itself, but under Alabama State Bar guidance the legal documents used at closing, such as the deed, must be prepared by or under the direct supervision of a licensed Alabama attorney, and nonlawyers may not give legal advice at the closing.

Also worth knowing

Nonresident sellers of Alabama real estate are subject to state income tax withholding of 3% or 4% of the purchase price at closing (or withholding based on the gain, using Form NR-AF2), under Code of Alabama section 40-18-86. Alabama residents are not subject to this withholding.

Also worth knowing

Even though Alabama sellers generally have no duty to volunteer defects, an "as is" clause does not protect against lying in response to a buyer's specific question, and real estate licensees have their own duty under Code of Alabama section 34-27-36 to disclose known defects that would matter to a reasonable buyer.
