Alaska rules that affect sellers

Transfer tax

Alaska does not charge a state real estate transfer tax on home sales. Sellers still pay ordinary closing costs such as title and settlement fees, and recording fees apply when the deed is recorded.

Seller disclosure

Alaska requires a written seller disclosure. Under AS 34.70.010, before a buyer makes a written offer on residential property, the seller must deliver a completed Residential Real Property Transfer Disclosure Statement (Real Estate Commission form 08-4229). A seller who negligently fails to comply is liable for the buyer's actual damages, and up to three times actual damages if the failure is willful.

Who handles the closing

Alaska home sales are customarily closed by title and escrow companies, and an attorney is not required to sell a house.

Also worth knowing

If the disclosure statement, or a material amendment to it, is delivered after the buyer has made a written offer, the buyer may cancel the offer by written notice within three days of in-person delivery or six days of delivery by mail (AS 34.70.020).

Also worth knowing

The disclosure statement can be waived only if the seller and buyer agree in writing (AS 34.70.110), and the first sale of a never-occupied home is exempt (AS 34.70.120). A waiver does not remove other disclosure obligations.
