Delaware rules that affect sellers
Transfer tax
Delaware's state realty transfer tax rate is 2.5% of the property's value where the county or town charges the full 1.5% local tax (3% where it does not), for a typical combined total of 4%. By statute the tax is split equally between seller and buyer, so a seller usually pays about 2%.
Local add-ons: Counties and towns may levy up to 1.5%. Where the full 1.5% local tax applies, the state rate drops from 3% to 2.5%, so the combined total is typically 4%.
Seller disclosure
Yes. Under Delaware's Buyer Property Protection Act, a seller of a home with one to four units must disclose all known material defects in writing, using the Seller's Disclosure of Real Property Condition Report, before signing the listing agreement, and must update it before settlement if anything changes. A copy goes to buyers before they make an offer and becomes part of the purchase agreement.

Who handles the closing
Delaware requires a Delaware-licensed attorney to conduct the closing of a sale of Delaware real property, under a 2000 Delaware Supreme Court ruling (Matter of Mid-Atlantic Settlement Services).
Also worth knowing
Non-resident sellers must pay an estimated Delaware income tax on the gain from the sale before the deed can be recorded, using Form 5403. The form is filed with every deed, even by residents, who simply claim the exemption.

Also worth knowing
Sellers must give buyers any radon test or inspection results they have and tell them about any known radon hazards, documented on a form created by the Delaware Real Estate Commission.
Also worth knowing
First-time home buyers get a reduction of up to $2,000 on their half of the transfer tax, but that break does not reduce the seller's half.
Checking an agent's license
Real estate agents in Delaware are licensed by the Delaware Real Estate Commission (Division of Professional Regulation). You can look up any agent before you work with them.

Prices and pace can be very different from one metro to the next, so the local page is a better guide than the statewide figure.
