Georgia rules that affect sellers
Transfer tax
Georgia's real estate transfer tax is $1 for the first $1,000 of the sale price and 10 cents for each additional $100, which works out to 0.1%. The seller is legally liable for the tax, though the parties frequently agree in the contract that the buyer will pay it.
Local add-ons: The Department of Revenue describes only the single state tax, paid to the clerk of superior court before the deed is recorded.

Seller disclosure
No Georgia statute requires a seller to complete a disclosure form, and Georgia courts generally apply caveat emptor (buyer beware) to home sales, with exceptions for fraud and concealment. Real estate brokers, however, must disclose adverse material facts about the property's physical condition that they actually know and that a reasonably diligent inspection would not reveal (O.C.G.A. 10-6A-5).
Who handles the closing
Georgia is an attorney-closing state. The Georgia Supreme Court has held that it is the unauthorized practice of law for anyone other than a licensed Georgia attorney to close a real estate transaction or to prepare or facilitate the execution of a deed.

Also worth knowing
When a nonresident of Georgia sells real property in the state, the buyer generally must withhold 3% of the sale price for state income tax, unless the seller provides an affidavit (Form IT-AFF2) allowing withholding to be figured on the gain instead.
