Idaho rules that affect sellers

Transfer tax

Idaho does not charge a state real estate transfer tax.

Seller disclosure

Yes. Under Idaho's Property Condition Disclosure Act (Idaho Code 55-2501 and following), a seller of a home with one to four units must complete the state's property disclosure form and deliver a signed copy to the buyer within 10 days of accepting the buyer's offer. Some transfers are exempt, such as court-ordered sales, foreclosures, and sales by estates or trustees.

Who handles the closing

Idaho closings are customarily handled by title and escrow companies, and state law does not require an attorney at closing, though either side may hire one.

Also worth knowing

A buyer can cancel the purchase agreement by giving written notice within 3 business days after receiving the seller's disclosure form. Sellers must also update the form before closing if anything on it changes.

Also worth knowing

Idaho law does not require a seller to disclose that a home is psychologically impacted, for example by a death or crime there, but a seller who is asked about it in writing is expected to answer truthfully.
