Indiana rules that affect sellers

Transfer tax

Indiana does not charge a real estate transfer tax. Sellers may still see ordinary closing costs and possible homeowners association fees.

Seller disclosure

Yes. Indiana's seller disclosure law (Indiana Code 32-21-5) requires a home seller to complete the state Seller's Residential Real Estate Sales Disclosure form and give it to the buyer before an offer is accepted. If a defect is disclosed after the offer is accepted, the buyer can cancel the contract and get deposits back.

Who handles the closing

Indiana closings are customarily handled by title companies, and state law does not require an attorney at closing, though either side may hire one.

Also worth knowing

Every sale needs a state Sales Disclosure Form (State Form 46021) filed with the deed. The county auditor will not accept the deed without a completed form stamped by the county assessor. The buyer can also use the form to apply for the homestead deduction.

Also worth knowing

The disclosure form is not a one-time task: Indiana law covers matters that come up after the form is delivered and requires certain changes to be disclosed at settlement.
