Kansas rules that affect sellers

Transfer tax

Kansas does not charge a real estate transfer tax. Its former mortgage registration tax was phased out and fully repealed beginning in 2019.

Seller disclosure

Kansas has no statute requiring sellers to fill out a specific disclosure form. However, real estate licensees must disclose to buyers all adverse material facts they actually know about, including the physical condition of the property, material defects, and environmental hazards that require disclosure (K.S.A. 58-30,106).

Who handles the closing

Kansas closings are customarily handled by title companies, and state law does not require an attorney at closing, though either side may hire one.

Also worth knowing

Even though no form is required, a seller's own agent must tell buyers about adverse material facts the agent actually knows, such as material defects in the property or its title, so known problems will generally come out in a brokered sale.

Also worth knowing

Kansas phased out its mortgage registration tax between 2015 and 2018 and repealed it entirely starting in 2019. Recording fees at county registers of deeds were raised during the phase-out to make up for the lost revenue.
