Kentucky rules that affect sellers

Transfer tax

Kentucky charges a real estate transfer tax of 50 cents for each $500 of value (0.1%) under KRS 142.050. By law the tax is imposed on the grantor, meaning the seller, and it is collected by the county clerk before the deed can be recorded.

Seller disclosure

Yes, when a real estate licensee is paid in the sale. KRS 324.360 requires the seller of a single-family home to complete and sign the Kentucky Real Estate Commission's Seller's Disclosure of Property Condition form (KREC Form 402) when signing the listing agreement. New construction with a warranty, auction sales and court-supervised foreclosures are exempt.

Who handles the closing

Kentucky closings are conducted by both attorneys and title companies. The Kentucky Supreme Court ruled in 2003 (Countrywide Home Loans v. Kentucky Bar Association) that non-lawyers may conduct real estate closings, so an attorney is not legally required, although non-lawyer closers cannot give legal advice.

Also worth knowing

The disclosure law applies to single-family home sales in which a licensed real estate agent is paid. The seller signs the form when listing, and the listing agent must deliver a copy to a buyer within 72 hours of receiving a written, signed offer.

Also worth knowing

Kentucky's disclosure form asks sellers to report all known conditions affecting the property, however and whenever they learned of them, and it is not a warranty or a substitute for the buyer's own inspection.
