Seller disclosure

Yes. Michigan's Seller Disclosure Act (MCL 565.951 and following) requires sellers of homes with 1 to 4 units to give the buyer a completed Seller's Disclosure Statement before the buyer signs a binding purchase agreement. If it is delivered after signing, the buyer may cancel within 72 hours of hand delivery (120 hours if sent by registered mail). Court-ordered, foreclosure, family and some estate transfers are exempt. Summary from a Michigan Realtors guide, since the state legislature's site could not be loaded.

Who handles the closing

Michigan closings are customarily handled by title companies. State law does not require an attorney at closing, though sellers may hire one.

Also worth knowing

A seller of a principal residence can be exempt from the state transfer tax (MCL 207.526(u)) when the home's state equalized value (SEV) at sale is no higher than it was at purchase and the sale is at arm's length. If the tax was already paid, a refund can be claimed on Form 2796 within four years and 15 days of the sale.
