Mississippi rules that affect sellers

Transfer tax

Mississippi does not charge a state real estate transfer tax on home sales. Sellers still pay ordinary closing costs such as title, attorney and recording fees. Confirm any local fees with your closing attorney.

Seller disclosure

Yes, when an agent is involved. Under Mississippi Code 89-1-501 to 89-1-527, a seller of a home with 1 to 4 units must give the buyer a Property Condition Disclosure Statement on the Mississippi Real Estate Commission's form when the sale is made by or with the help of a licensed broker or salesperson. It is due before the buyer signs an offer or contract.

Who handles the closing

Mississippi requires a licensed attorney to examine and certify title, and an attorney prepares and reviews the legal documents in a typical home sale. Title companies also take part in the closing.

Also worth knowing

If the Property Condition Disclosure Statement is delivered after the buyer has made an offer, the buyer may cancel without penalty within 3 days of hand delivery or 5 days after it is mailed, and any earnest money must be returned.
