Montana rules that affect sellers

Transfer tax

Montana has no real estate transfer tax. Since a 2010 constitutional initiative (CI-105), Article VIII, Section 17 of the state constitution bars the state and any local government from taxing the sale or transfer of real property.

Seller disclosure

Yes. Since 2023, Montana law (MCA 70-20-502) requires sellers of homes with 1 to 4 units, and condos, to give the buyer a written disclosure statement of adverse material facts they actually know about, before or when the contract is signed. The statute lists the topics to cover, such as water, septic, structure, unpermitted additions and hazardous materials, but there is no single state-issued form.

Who handles the closing

Montana closings are customarily handled by title and escrow companies. State law does not require an attorney at closing, though sellers may hire one.

Also worth knowing

Unless the buyer and seller agree otherwise in writing, a purchase contract does not take effect until 3 days after the buyer receives the seller's disclosure statement, and the buyer may withdraw without penalty during that time.

Also worth knowing

Under the Montana Mold Disclosure Act, a seller who knows mold is present must tell the buyer before or at contract signing, and a seller who knows the building was tested must share the results and any treatment records.
