New Hampshire rules that affect sellers
Transfer tax
New Hampshire's real estate transfer tax (RSA 78-B) is $0.75 per $100 of the price, charged separately to both the buyer and the seller, so each side pays 0.75% and the total is 1.5%. There is a $20 minimum on sales of $4,000 or less.

Seller disclosure
Partly. New Hampshire has no statewide comprehensive condition form, but RSA 477:4-c and 477:4-d require the seller to give the buyer a signed written disclosure covering the private water supply, sewage or septic system, insulation, flood hazard zone status and any residential heating oil underground tank. RSA 477:4-a also requires a signed notice about radon, arsenic, lead, PFAS and flood risk.
Who handles the closing
New Hampshire closings are handled by title companies or attorneys. Sources disagree on whether an attorney must be involved, and no official source reviewed says one is required, so confirm with your title company or attorney.

Also worth knowing
Before a purchase contract is signed, the seller or seller's agent must give the buyer a state-worded notice about radon, arsenic, lead, PFAS and flood risk, and the buyer signs a copy to acknowledge it.

Also worth knowing
The transfer tax is calculated separately for each party and rounded to the nearest whole dollar. On a $535,000 sale, for example, the seller and the buyer each owe about $4,013.

Checking an agent's license
Real estate agents in New Hampshire are licensed by the New Hampshire Real Estate Commission (Office of Professional Licensure and Certification). You can look up any agent before you work with them.
Rules checked 2026-09-30. They change, and local practice varies: confirm with your title company, closing attorney or agent before relying on them. This is general information, not legal or tax advice.

Prices and pace can be very different from one metro to the next, so the local page is a better guide than the statewide figure.
