New Mexico rules that affect sellers

Transfer tax

New Mexico does not charge a real estate transfer tax. Sellers still pay ordinary closing costs such as title, escrow and recording fees.

Seller disclosure

No general seller disclosure form is required by New Mexico statute; the state's disclosure law (NMSA 47-13) focuses mainly on property taxes. In practice the standard New Mexico Realtors purchase agreement obliges the seller to disclose known adverse material facts, and brokers must disclose adverse material facts they know about. Who handles the closing

New Mexico closings are customarily handled by title and escrow companies. State law does not require an attorney at closing, though sellers may hire one.

Also worth knowing

Under NMSA 47-13-4, before accepting an offer the seller must ask the county assessor for an estimate of the property tax at the listing price and give the buyer a copy of the assessor's response.
