Oklahoma rules that affect sellers

Transfer tax

Oklahoma's documentary stamp tax (68 O.S. 3201) is 75 cents for each $500 of consideration or fractional part, which works out to 0.15% of the sale price. The Oklahoma Real Estate Commission's standard residential contract assigns documentary stamps to the seller.

Local add-ons: None described in the Oklahoma Tax Commission notice; stamps are bought from the county clerk when the deed is filed.

Seller disclosure

Under the Residential Property Condition Disclosure Act (60 O.S. 831 to 839), sellers of homes with one or two dwelling units must give the buyer a written Residential Property Condition Disclosure Statement before accepting an offer. A seller who has never lived in the home and knows of no defects may use the Disclaimer Statement instead. The Act applies when the seller uses a real estate licensee, or when an unrepresented seller receives a written request from the buyer.

Who handles the closing

Oklahoma closings are customarily handled by title or escrow companies rather than attorneys, according to a title insurer's industry summary. The Real Estate Commission's standard contract bases title insurance on an attorney's title opinion, so attorneys still play a role in title review.

Also worth knowing

Under the Commission's standard residential contract, the seller pays to provide an abstract of title certified by a licensed Oklahoma abstract company (or an existing owner's title policy plus a supplemental abstract), completed within 30 days before closing.

Also worth knowing

If a seller learns of a new defect after delivering the disclosure statement, the Act calls for an amended disclosure. Licensees must also tell buyers about known defects missing from the seller's statement.
