South Dakota rules that affect sellers

Transfer tax

South Dakota imposes a real estate transfer fee of 50 cents for each $500 of value (0.1%), and state law says the fee is paid by the grantor (the seller).

Seller disclosure

Yes. South Dakota law requires sellers of residential property with up to four dwelling units to give the buyer a completed Seller's Property Condition Disclosure Statement, in the form set out in SDCL 43-4-44, before the buyer makes a written offer. If the seller learns of a change in a material fact before closing or possession, the seller must provide a written amendment.

Who handles the closing

South Dakota closings are customarily handled by title or escrow companies, and an attorney is not customarily required. This is based on a title insurer's industry summary, not an official state page; confirm with your title company or attorney.

Also worth knowing

If the disclosure statement or a material amendment reaches the buyer after the buyer has made a written offer, the buyer may terminate the offer by written notice within 3 days of in-person delivery, or within 6 days if it was mailed.

Also worth knowing

A sale is not invalidated just because the disclosure rules were not followed, but a person who intentionally or negligently violates them is liable to the buyer for actual damages and repairs, and a court may award attorney fees.
