Utah rules that affect sellers

Transfer tax

Utah has no state real estate transfer tax, and a title insurer's state-by-state summary lists no deed transfer tax for Utah. Sellers still pay ordinary closing costs such as title and escrow fees. (Secondary source; no official page states the absence of the tax directly.)

Seller disclosure

Utah has no statute requiring a general seller disclosure form. Instead, the Utah Supreme Court held in Mitchell v. Christensen (2001 UT 80) that sellers owe a duty to disclose known material defects that a reasonable inspection by an ordinary prudent buyer would not reveal. In practice most sellers use the Utah Association of REALTORS disclosure form.

Who handles the closing

Utah closings are customarily handled by title companies, and an attorney is not customarily required. This is based on a title insurer's industry summary, not an official state page.

Also worth knowing

An owner who actually knows a property is currently contaminated from the use, storage or manufacture of methamphetamine must disclose that in the sale. This is the one seller disclosure spelled out by Utah statute.

Also worth knowing

Utah law says the fact that a property is stigmatized is not a material fact, and neither the owner nor the agent is liable for not disclosing it.

Also worth knowing

Although no statute requires it, Utah agents commonly have sellers complete the Utah Association of REALTORS seven-page disclosure form, and a seller who hides a known issue can be held liable.

Checking an agent's license

Real estate agents in Utah are licensed by the Utah Division of Real Estate (Department of Commerce). You can look up any agent before you work with them.

Metro areas in Utah

Prices and pace can be very different from one metro to the next, so the local page is a better guide than the statewide figure.
