Virginia rules that affect sellers

Transfer tax

Virginia's grantor tax is 50 cents for each $500 of the sale price (about 0.1%), and by statute the seller (grantor) pays it unless the parties agree the buyer will pay some or all of it. The buyer separately pays the state recordation tax on the deed of 25 cents per $100. Localities in the Northern Virginia Transportation Authority add a regional fee of 10 cents per $100, also owed by the seller.

Local add-ons: Northern Virginia Transportation Authority localities add a 10 cents per $100 regional fee paid by the grantor (Va. Code section 58.1-802.3).

Seller disclosure

Under the Virginia Residential Property Disclosure Act, the seller must give the buyer the Residential Property Disclosure Statement published by the Virginia Real Estate Board. The statement is largely a buyer beware notice: the seller makes no representations about the property's condition and the buyer is told to do their own due diligence on listed matters such as flood risk, zoning and environmental issues. Separate statutory disclosures, such as military air installation noise zones, still apply.

Who handles the closing

Virginia closings (called settlements) are handled either by attorneys or by registered lay settlement agents such as title companies, and an attorney is not legally required. Both types of settlement agent are regulated under the Virginia Real Estate Settlement Agents Act.

Also worth knowing

If the home is in a property owners' association, the seller or the seller's agent must obtain a resale certificate from the association and give it to the buyer. The buyer has a right to cancel the contract that is waived if not used before settlement.

Also worth knowing

In any locality with a military air installation, the seller must disclose on a Real Estate Board form whether the property is in a noise zone or accident potential zone.

Also worth knowing

The Real Estate Board revised the Residential Property Disclosure Statement for changes in the law effective July 1, 2026, so sellers should make sure the current version of the form is used.
