Wyoming rules that affect sellers

Transfer tax

Wyoming has no state real estate transfer tax and no documentary stamp tax; only county recording fees apply. Counties do not add a transfer tax. (Secondary source; no official page states the absence of the tax directly, though the Legislature has studied but not enacted one.)

Seller disclosure

Wyoming has no statute requiring a seller disclosure form, and the state largely follows caveat emptor (buyer beware). Sellers still cannot hide or misrepresent known defects, and real estate licensees must disclose to buyers any adverse material facts they actually know about the property's title, physical condition, defects and environmental hazards.

Who handles the closing

Wyoming sales commonly close through a title or escrow company acting as a neutral settlement agent, and an attorney is not required for a routine residential closing. (Secondary source.)

Also worth knowing

When a deed is recorded, a Statement of Consideration listing the sale price must be filed. It is not a public record and is held confidential by county and state officials, so Wyoming sale prices are not published in public records.

Also worth knowing

Even without a seller disclosure form, an agent working on the sale must tell buyers about adverse material facts the agent actually knows, so sellers should expect known problems to be shared.
