Arizona rules that affect sellers
Transfer tax
Arizona has no real estate transfer tax. Article 9, Section 24 of the Arizona Constitution bars the state, counties, cities and other local governments from imposing any new tax, fee or stamp requirement on the sale or transfer of real property, beyond those that existed on December 31, 2007. Ordinary recording fees still apply.
Seller disclosure
No Arizona statute requires a specific seller disclosure form, but sellers have a legal duty to disclose known material facts about the property, even in an "as is" sale. In practice nearly all listed homes use the Arizona REALTORS Seller's Property Disclosure Statement (SPDS).

Who handles the closing
Arizona closings are customarily handled by a title company acting as a neutral escrow agent, which prepares the closing package and manages signing. An attorney is not required, and parties can sign remotely before a notary.

Also worth knowing
A seller of a home in an HOA must give the buyer the association's documents (declaration, bylaws, rules, assessments, budget, pending litigation and more) within 10 days. The association's fee for preparing them is capped at $400 per transaction.
Also worth knowing
A seller of five or fewer unsubdivided parcels in an unincorporated area of a county must give the buyer a recorded affidavit of disclosure at least seven days before transfer, and the buyer may rescind within five days of receiving it.
Also worth knowing
Sellers are not liable for failing to disclose that the property was the site of a natural death, suicide, homicide or other felony, or is near a registered sex offender.
Checking an agent's license
Real estate agents in Arizona are licensed by the Arizona Department of Real Estate. You can look up any agent before you work with them.
Rules checked 2026-09-30. They change, and local practice varies: confirm with your title company, closing attorney or agent before relying on them. This is general information, not legal or tax advice.
Metro areas in Arizona
Prices and pace can be very different from one metro to the next, so the local page is a better guide than the statewide figure.
