Arizona rules that affect sellers

Transfer tax

Arizona has no real estate transfer tax. Article 9, Section 24 of the Arizona Constitution bars the state, counties, cities and other local governments from imposing any new tax, fee or stamp requirement on the sale or transfer of real property, beyond those that existed on December 31, 2007. Ordinary recording fees still apply.

Seller disclosure

No Arizona statute requires a specific seller disclosure form, but sellers have a legal duty to disclose known material facts about the property, even in an "as is" sale. In practice nearly all listed homes use the Arizona REALTORS Seller's Property Disclosure Statement (SPDS).

Who handles the closing

Arizona closings are customarily handled by a title company acting as a neutral escrow agent, which prepares the closing package and manages signing. An attorney is not required, and parties can sign remotely before a notary.
