Nebraska rules that affect sellers

Transfer tax

Nebraska's documentary stamp tax is $3.32 per $1,000 of value (0.332%) for transfers before January 1, 2032, after which it drops to $2.32 per $1,000. By statute it is a tax on the grantor (the seller), collected by the county register of deeds when the deed is recorded.

Seller disclosure

Yes. Neb. Rev. Stat. 76-2,120 requires sellers of homes with 1 to 4 units to give the buyer a signed Seller Property Condition Disclosure Statement, on the form set by the Nebraska Real Estate Commission, on or before the date the buyer becomes bound by a purchase contract. The buyer acknowledges receipt in writing.

Who handles the closing

Nebraska closings are customarily handled by title companies. State law does not require an attorney at closing, though sellers may hire one.

Also worth knowing

The documentary stamp tax rate was set at $3.32 per $1,000 for transfers before January 1, 2032 and is scheduled to fall to $2.32 per $1,000 after that date.

Also worth knowing

If a sale closes without the required disclosure statement, the buyer can sue the seller for actual damages, court costs and attorney's fees, within one year after taking possession or the deed transfer, whichever comes first. The seller is not liable for errors outside their personal knowledge.
