Nevada rules that affect sellers

Transfer tax

Nevada's real property transfer tax is $1.95 per $500 of value (0.39%) in counties under 700,000 people and $2.55 per $500 (0.51%) in Clark County. Buyer and seller are jointly liable by law and may agree in the contract which of them pays, so who pays varies by area and deal.

Local add-ons: Clark County's rate is $2.55 per $500 (0.51%). Some other counties, including Washoe, add a small local amount; check with the county recorder.

Seller disclosure

Yes. NRS 113.130 requires the seller to complete the Seller's Real Property Disclosure form and serve it on the buyer at least 10 days before the home is conveyed. The seller's agent may not fill it out for the seller, and the buyer cannot waive it.

Who handles the closing

Nevada closings are customarily handled by title and escrow companies. State law does not require an attorney at closing, though sellers may hire one.

Also worth knowing

Washoe and Churchill counties charge an extra $0.10 per $500 on top of the base transfer tax, and Clark County's rate includes an additional $0.60 per $500 for the county school district.

Also worth knowing

In a homeowners association community, the seller must furnish a resale package (governing documents, dues, fees, budget and pending legal actions) at the seller's expense, and the buyer may cancel the contract until midnight of the fifth calendar day after receiving it.
